Introduction

Just a few short years ago, I would have been considered by many as being totally out of touch with reality if I suggested that America was headed towards a one-world government run by the United Nations. Now the UN has its own web sites showing the benefits of its version of "global governance" while the UN publicly pursues authority over sovereign nations around the globe.

Just a few short years ago, I would have been called a conspiracy nut for even mentioning black, unmarked helicopters. Now these same black helicopters are used to support roadside stops to make sure Americans are wearing their seatbelts, and in door-to-door "mock" exercises to confiscate guns and serve warrants.

Just a few short years ago, I would have been called an extremist wacko for suggesting there was such a thing as government-sponsored mind control programs or chemtrails being sprayed in the air above us. Then there was a movie made about Conspiracy Theories which directly exposed the MK Ultra program. Now there is legislation introduced in Congress to outlaw these same chemtrails.

Just a few short years ago, I would have been condemned as unpatriotic and a rabble-rouser if I claimed that in the near future the United States Military could be used in house to house searches with full arrest authority. Now President Bush has passed his so-called anti-terrorism bill that gives the military just that authority if someone claims his/her neighbor is a domestic terrorist. And no proof is required for this new "service," merely allegations.

Just a few short years ago, I would have been laughed at had I suggested that the state could arrest someone for not taking a pill or vaccination that its governor had decided was important for public safety. Now, there are bills being introduced in all fifty states that gives the governors the authority to use the National Guard to arrest, remove and incarcerate me if I refuse to take some vaccine mandated by his office because of some perceived biological threat. In addition, they can burn down my house and confiscate my car for my disobedience. Often, these same laws force me to vaccinate my child under threat of jail time.

Make no mistake about it; our world is a dangerous place to live. And not all the bad guys wear masks. Most central governments around the world are not very friendly toward their people. And most nations are not very friendly toward their neighboring countries. Further, many countries are so poor that they see hosting terrorism or terrorists as a revenue source.

Currently, our military is spread around the world in over one hundred nations. There are police actions, peacekeeping missions, contract arrangements and other security concerns that keep most of our military personnel outside this country for extended periods of time. The Clinton Administration reduced funding for intelligence services so drastically that our major source of intelligence is now other intelligence services. [http://www.wnd.com/news/article.asp?ARTICLE_ID=26477] Our military has reduced its available weapons to the point that when Clinton left office it was estimated that we no longer had enough Tomahawk and Cruise missiles to defend our nation. This is one reason why we didn't hear about any of these missiles being used against Osama bin Laden in Afghanistan.

And many Americans have become so complacent in their comfortable existence that they are totally out of touch with the almost complete lack of freedom and comforts that most of those around the world experience daily. Most countries have nothing like the liberty we take for granted, or the creature comforts we expect is our lot just for being Americans. And, above all, Americans have felt safe within our borders. All of the wars in memory have been fought elsewhere, with other nations suffering the ravages of war. Even the terrorism in Northern Ireland and the Mid-East have seemed very far away from us since so few Americans travel to places where that unrest, violence and death has become a way of life.

Since that tragic day in September, Americans have begun to understand what it means to have little security. We saw for the first time just how vulnerable we have become, just how easy it was to murder thousands of Americans in a few short hours. And we didn't like what we saw. We also saw just how easy it was for terrorists to get inside our country. But what we haven't seen is how quickly our government and our elected officials moved to capitalize on those horrible actions by terrorists.

Yes, I said capitalize. You see, the dust hadn't settled and the smoke hadn't cleared before our government was telling us many times a day that Americans would have to give up some freedoms in order to combat terrorism. The media repeated this mantra many times a day for weeks to help Americans get used to the idea. We heard that reduced freedom was the price Americans had to pay for increased security. It was never explained how much freedom had to be reduced or how much increased security would be produced by that reduction in freedom, but we were carefully and thoroughly conditioned to accept whatever reduction in freedom our government was going to hand us and whatever increase in security we might experience. Further, it was implied by many and suggested by some that any resistance to these proposed but undescribed reductions in freedom would be viewed as a lack of patriotism. At a time when many Americans were flying flags (a good thing!) for the first time (a bad thing!), no one wanted to be seen as unpatriotic. In a country where millions of new bumper stickers and signs declared our national unity, no one wanted to break step and ask just how much freedom would we have to give up and just how much increased security would we get in return. If the media and our politicians were to be believed, it seemed that all Americans were lining up to surrender freedoms so they could experience some small amount of peace in their newly vulnerable lives. And then Attorney John Ashcroft gets on the airwaves and tells Americans that even suggesting the federal government was reducing Americans' rights was nothing more than aiding the terrorists. His clear and bold attempt to intimidate into silence Americans who were watching closely was just one more board in the coffin containing our Constitution. But it was, perhaps, the most despicable board in that coffin!

A few weeks ago I was standing in a line at a local grocery store where I heard two women talking about the American flags they were now displaying on their cars. Not one to be afraid of engaging strangers in conversation, I congratulated both women on flying our National Symbol. Then I added the fact that I had been flying two flags on the dashboard of my van since I had purchased it years earlier. I stated it was unfortunate that it took the murder of thousands of American lives for so many Americans to fly their flag. Needless to say, both women expressed their views of me in very unpleasant words.

To these two ladies, 9-11 meant that you flew flags to show your national unity. But 9-11 meant much more than that to the socialists in control of America. Without many apparently noticing, the months following 9-11 saw many state and federal laws passed, some drastically restricting freedoms and rights which until that day had been taken for granted by most Americans. But most Americans were too busy flying flags to notice that these flags stood for much less freedoms now.

To many in America, this seems to not be a problem. A little socialism is not bad, as long as it protects the children, many would say. But in a country created to be free, some would call this treason.

This past summer, I received a long distance telephone call from a radio talk show host in Italy. He wanted to interview me about what he called the American militia movement. As we spoke for more than an hour, he finally asked me the question, "Why are so many Americans against a one-world government headed by the United Nations?" (In America, our media and politicians tell us that the UN has no such agenda, while around the world they know better.) I explained that most countries had national governments that were much more coercive than the UN's requirements would allow. And most people in many countries around the world experienced social restrictions that were far worse than the United Nation's version of "global governance" would promise. Further, most nations were more socialistic than the UN promised to be. So, for most people, it would be an improvement in their liberties and their social and economic prospects under a one-world government led by the United Nations. One the other hand, as I explained to the talk show host, the United States of America was created as the freest nation in history. Our Constitution guaranteed complete individual liberty, limited only by another individual's rights. Further, our Constitution limited the central government to the powers allowed it by We the People in that very Constitution. In other words, I explained, the global governance planned by the United Nations would be a major step backwards in our liberties and our social and economic prospects. We would have to give up much in order to be like the rest of the world. This made sense to the talk show host, and he indicated that he could understand for the first time why America was so "uncooperative" toward the United Nations, as he described us.

Into this discussion must creep some details about the structure of American politics, especially the conservative side. According to almost every poll, most of Americans would consider themselves on the right side of the political spectrum. Several years ago, CNN conducted a poll which indicated that about three-quarters of Americans either 1) believed that America was heading into socialism and that was wrong, or 2) they believed their federal government would do something against them wrongfully. This was a terrible indictment of our federal government, suggesting that most of Americans believed the government was not our friend, and this just when the media wanted everyone to believe that Bill Clinton was a wonderful addition to American politics. So CNN described this poll on only one broadcast that I saw, and then never mentioned it again to my knowledge.

This poll suggested that three-quarters of Americans were conservative by some measure, or, at the very least, didn't trust their government. Most polls suggest upwards of fifty percent, and many polls as much as sixty-five percent, can be considered politically conservative. This would result in a number as large as 140 million American adults who consider themselves some sort of conservative. Of this number, there is a smaller portion that would call themselves part of the Patriot Movement. The Patriot Movement is hard to describe, but most who claim to know these things give a long list of traits or characteristics which comprise this group of Americans. Among the descriptors are those who believe America is a socialistic democracy, who take the Constitution literally, who believe in States' Rights, who place a higher value on God-given constitutionally-protected rights over government-given civil rights, and who consider themselves to be conservative Christians. Since more enemies mean more money, organizations that make their living from pursuing hate groups almost always include Neo-Nazi groups, skinheads and other racial groups in the Patriot Movement. However, few if any who would call themselves Patriots would ever include these latter groups within their Movement. The Patriot Movement is no more and no less colorblind than are teachers or police or politicians or mechanics, because it is these typical Americans who make up the Patriot Movement.

So we have as many as 140 million Americans within what we might call Conservative America, and perhaps as many as 25 million in the Patriot Movement. Within the Patriot Movement is a smaller group who believe that America has moved so far into socialism that it might be too late to do anything about it, short of armed revolution. This group is often referred to as the American Militia Movement, and estimates of its size run anywhere from a few hundred thousand to perhaps five million.

In spite of what the federal government would have Americans believe, the Militia Movement is not comprised of domestic terrorists just looking for federal buildings to blow up and federal officers to shoot. They are not seeking an excuse to wage war against America. Timothy McVeigh was never part of the Militia Movement!

There are very few points which all militia groups have in common. There are, however, two points shared by all militia groups. First, they believe that this Great Nation was created by God-fearing men to be a Constitutional Republic, and not created to be a democracy. Second, they believe the enemy they face are the socialists and the globalists who have already overthrown the republic America once was. The enemy IS NOT the American people, but those who control the American people. The American Militia Movement is not a revolutionary movement, but a counter-revolutionary movement. They believe that the revolution has already occurred, and that America has already been taken over by socialists intent on moving America into a totalitarian nation.

Obviously, this is a radical statement, and is ridiculed by all Americans to the left of center. Yet stop and consider something. Take the time to look up the ten planks of Marxism, that bedrock belief of socialism, and you will see that nine of the ten planks are alive and well in America, already implemented by the socialists in control of our federal government. As Karl Marx would measure us, America is ninety percent socialist already.

There has been a revolution, and you didn't even know it!

When was the last time you heard anyone in government or the media describe America as a republic? Probably not in twenty or thirty years.

When was the last time you heard anyone in government or the media refer to America as a democracy? Probably today. Those who rule over us are carefully training Americans to think of this nation as a democracy.

Why is this? you might ask. Excellent question, and one that I hope haunts you for a long time. You see, a democracy is three wolves and one sheep voting on what is for dinner. In a democracy, all it takes is a majority for something to happen. This is why almost nothing is done in America today without a number of polls. It is implied that if a majority of Americans favor a particular course of action, or a particular law, then it must be okay to move in that direction or pass that law. Not so in a republic. In a republic, all of America might desire a particular course of action or a particular law passed, but if the Constitution doesn't allow for it, nothing happens!

Our politicians want us to believe America is a democracy so they don't have to worry about the limits in the Constitution!

In all of history, all democracies slid into socialistic totalitarianism or they were overthrown. And America is in the process of proving this once again.

People in the Patriot Movement see this happening before our eyes. People within the Militia Movement are committed to keeping this from happening.

Those in power who continue to introduce and pass legislation that clashes with the Constitution are enemies of that Constitution. And those within the Militia Movement take seriously their pledge to protect and defend the Constitution against all enemies, both foreign and domestic.

Many have suggested that if our Founding Fathers were alive today, most of the Presidents and most in Congress for at least the past twenty years, and possibly for the past sixty years, would be tried for treason.

By any measuring stick the Founding Fathers would have used, America is a socialist nation with a treasonous government!

Most Americans are too busy making a living to watch how our paid public servants are moving us deeper into totalitarianism. It is happening so subtly that We The People seem to have fallen asleep. And those same servants are depending on this remaining true until it is too late. But over the past few months, subtlety has been left behind. The events of September 11 have given the socialists in control of this once-Great Nation the device to move rapidly in their efforts to wrest the last of our Constitutionally guaranteed liberties from us.

Those in control of us know that the Militia Movement is the only force in America that could stop them from accomplishing their globalist agenda. So many believe it is only a matter of time before they make a move against the Militia Movement. This move has started subtly, by making the militias in America appear as hate groups and domestic terrorists. The media has lied about and misrepresented militias for years. The FBI has published documents and held seminars specifically describing them as potential or domestic terrorists. Nowhere in any national media has any militia group ever been painted in a positive or accurate manner. Not since the Revolutionary War, when our very freedom from a foreign king was won by local militias, with help from a small Continental Army.

In Lopez v. the United States, the Supreme Court declared that the federal government has no authority or jurisdiction over gun ownership or possession. Yet this has not stopped thousands of restrictions, already declared by the US Supreme Court to be unconstitutional, from being passed. And certain socialists in Congress have made the complete and total elimination of personal ownership of guns their political priority. They have already pushed for laws they knew in advance to be unconstitutional, so we can expect they will continue to push for other unconstitutional legislation to totally and finally outlaw guns. When guns are finally outlawed, then these socialists know there can be no effective resistance to their plans for your future.

Trust history on this, people. The plans of socialists for their subjects are never good for the subjects!

Militia groups have pledged their lives and their honor in the effort to keep these socialists from totally taking over our country. The federal government fears this resistance, and cannot allow it to continue unchecked.

This book describes one way in which this government might move against the American militias. It is fiction, but perhaps only because it hasn't happened yet.

A Personal Note

I have included the entire text of a speech presented by another, whom I consider a great American that truly understands from whence we have come.

Several years ago, the House of Representatives had voted to impeach President Clinton for a number of actions they considered impeachable. The Senate then held hearings on whether or not to remove Clinton from the White House.

I do not include the following speech because of its comments on Bill Clinton. Personally, I believe those in control of our nation allowed the impeachment to move forward to hide other actions on the part of Bill Clinton that in my opinion were far more treasonous. Further, I believe that what the Senate did in that trial was even more impeachable than the scandals for which Bill Clinton was tried.

I include the following speech only because the author fully understood what America was created to be, and what America has become.

Please read the following speech and consider very carefully what this man proclaimed to a crooked Senate, an indifferent nation, an uncaring world.




THE FOURTEENTH HOUSE MANAGER'S CLOSING ARGUMENT

Ladies and Gentlemen of the Senate, I have been given an ominous task. I don't represent any particular district, as do the other house managers. I have been asked to present the closing argument for all the Sons and Daughters of Liberty, a dying breed, but one that has many constituents within the borders and beyond the shores of the United States of America. This is perhaps the most weighty job I have ever undertaken.

Much eloquence has been spoken from both sides of the argument for and against the impeachment of the president. Such has been the adroitness of the presenters, that I figured to adequately represent Maid Liberty, I must call upon the Greatest Wisdom, the Highest Truth, the Truest Honor. In attempting to reach such lofty goals, I remembered that Hillary Clinton was reported to have had conversations with Eleanor Roosevelt, so I thought I might try to follow suit.

Since the question before the Senate is one of grave constitutional significance, I reflected upon which Founding Father I could speak with to answer the question of whether perjury, witness tampering, and obstruction of justice, all for personal gain, rose to the level of high crimes and misdemeanors and therefore mandated a dismissal of the president.

My first thought was Thomas Jefferson, but, alas, he was in Paris when the Constitution was written. I also dismissed calling upon Benjamin Franklin because he was ever so close to death by the time the Constitution was ratified. As I ticked off the list of some of my favorite Americans, such as Patrick Henry and Richard Henry Lee, I had to scratch them because they opposed the Constitution out of fear that a despotic federal government would arise from the document. I feared all I would hear from one of them would be a resounding, "I told you so!"

Then, an inspiration hit me . . . I knew who to contact . . . but, was uncertain as to how. What would be the first step in conjuring up a Founding Father? As I contemplated this problem, I went into a deep trance . . . or did I fall asleep? Regardless, my recollection of the events is as clear as if I had been fully awake.

This is how it happened, the strange event, so powerful was it that I need not follow my colleagues and make comparisons of Clinton to Marlon Brando in The Godfather, or allude to literary figures like the character in The Prince by Machiavelli, or even compare Clinton to some Roman emperor, such as Caligula. I would experience the real thing . . . take my answer right from a Founding Father . . . there would be no metaphors or similes for me!

As I lay in an odd state of stupor, where I was alert, yet also uncertain of whether I was conscious or having a lucid dream, concentrating with all my energy upon the Founding Father I had chosen to assist in the troublesome task, I heard a loud knock, arose, and answered the door.

Standing on my porch was a diminutive man, nearly a foot shorter than I, with unruly hair whose appearance astonished me. His clothing fit tightly about him, with frills on his sleeves and collar flowing out from his burnt-orange coat. As I stood dumbfounded and wondering what this costumed clown was doing at my door, I looked into his eyes and recognized an intelligence beyond any I have ever encountered, so I invited him into my house.

"What may I do for you?" I asked, to which he replied that I had sent for him. I scratched my head, and said I doubted that very much. He laughed and said that he was actually a substitute for whom I had requested. Then it hit me, I had requested the assistance of John Jay, the first Chief Justice of the Supreme Court, but he was apparently not available. I introduced myself and inquired as to who was in my home. "James Madison, at your service."

Nothing could have shocked me more than his introduction. I had always known Madison to have been such a giant of an intellect that I had wrongly assumed that such a magnificent mind could not be packaged in such a tiny body, and I told him so. His response did nothing to allay my amazement.

"My mind is smaller than a mustard seed," said he, "but it is tied to the greatest network of intelligence that you could imagine."

Wanting dearly to explore the metaphysical implications of his comment, but now remembering my task at hand, I changed the subject. "Sir, could you assist me in a grave task? The House of Representatives has impeached our 42nd president, and I have been asked to give a closing argument at the impeachment trial in the Senate."

Madison's cheerful eyes turned black as he contemplated what I had said.

"How dark it must be in America that you are impeaching the president!" he exclaimed.

"Oh, the president's defenders say it is not dark at all, but that we, the prosecutors have too dark a view of the republic. They point to many things, claiming the economy has been great under this president, that there are few wars, that the people love the man, so, his defenders say, he should not be removed."

"What wrong is your president charged with?" asked Madison.

I laid out the details, the allegations of perjury, of obstructing justice, and concluded with this question: "So, Mr.. President, you were the chief author of the Constitution, the writer of 29 of the Federalist Papers which you signed 'Publius,' and a Founding Father of this republic. Do perjury and obstruction of justice under these sordid circumstances arise to a high crime or misdemeanor as contemplated in Article II, Section 4 and mandate the president's removal from office?"

The little man fell into a chair, dropped his head into his palms, and wept. His tears were so large that they poured through the crevices of his hands and dripped onto his pant legs. He sniffed. He coughed. And, he cried for several minutes before looking at me with tear-soaked eyes. "Is . . . is . . . that what America's come to? Has she fallen that far?"

I nodded.

He wheezed again, and then, miraculously, this little man who had just been bawling jumped to life. His eyes dried, his countenance lightened, and he was ready. "If that's what you're about, we better get to work," he said. "How is the vote estimated to go."

"Well, we now have fifty states, so there are one hundred senators." This piece of information seemed to cheer Madison up and he showed a tinge of pride in his expression. "It's going to break down on party lines, fifty-five Republicans will probably vote to convict. The forty-five Democrats will vote to acquit."

"What!?" he screamed. "Democrats? Where did a party get a name like that?"

I gulped. "Well, you see, the media and the history books all tell that this country is a democracy, so the party is named to signify the followers of a democracy."

"No!" shouted Madison. "We had Democratic-Republicans in my day. But, Democrats! No! Never! This is not a democracy! That is a base lie! We considered whether to form a democracy and rejected the concept flatly. Both democracy and monarchy were evaluated and smitten. This country is a REPUBLIC. Where in the Constitution is found the word 'democracy' I ask you? Nowhere, and I know, I wrote most of the document. This is terrible. Your people will perish for lack of knowledge."

I shrugged, and nodded.

"Okay, let's keep working. Do you have transcripts of the witnesses who testified in the trial?" asked Madison.

"Well, no."

"Why not? How are we going to put together a closing argument if we don't know the testimony?"

"You see," I stammered, "the Senate didn't allow us to call a single witness into the trial."

Madison stamped his feet and screamed, "A trial with no witnesses! What kind of a mockery is going on in that infernal Senate?"

I then explained the horrific rulings the Senate had made, how it had restricted us from prosecuting the president, explained the sham in its full ugliness.

"This reminds me of the tragedy brought upon this republic when Chief Justice John Marshall rigged the trial for that traitor, Aaron Burr. Which reminds me, what has the current Chief Justice been doing during this mock trial?"

"Next to nothing," I said. "He might as well be a puppet for the Senate doing their bidding."

"So, the Senate's corrupt, as is the Supreme Court. Lucky there is still a House of the people." Madison paced a moment, then looked out my window, before smiling almost gleefully. "I know just the answer for such a travesty of justice. We'll cut it off right now! We'll just have to notify the legislatures of those fifty states to recall the senators because of the sham that is ongoing."

I frowned.

"Why so glum," asked Madison. "I know it's a lot of work, but after one state sees the light, they'll all follow suit. We'll have a whole new Senate in no time at all."

"The states don't have any control over the Senate. In 1913, under the Seventeenth Amendment to the Constitution, the members of the Senate are no longer elected by the legislatures of the various states, but instead, by popular vote of the people."

"No! No! No! You've got to be kidding. Did the people not read Federalist Papers 62 and 63? The greatest fear of everyone in my day was that the Senate would become an elite group of tyrants because their terms were six long years. The only check on this was that all senators were subject to recall by their state legislatures, so it was presumed that all senators would only do bidding that benefited the state they represented. Without this check, the federal power could destroy all of the states' rights."

"It already has," I admitted.

"Tell me, does the president have much power today?" he asked, not seeming to hear my comment.

"A great deal."

"How so?"

"Well, he is commander-in-chief of the most powerful military on the earth. He commands the Navy, Marines, Air Force and the Army."

"I don't know what a air force is, but do you have a standing army?"

"Yes."

He ripped my copy of the Constitution from my hands and shouted, "Where does this document authorize a standing army?"

I shrugged.

"What other powers has he?"

"He commands the federal police force, the FBI, the internal revenue officers, the IRS, the covert operations, the CIA . . ."

"Stop! Where did he get these powers?"

"I-I think mostly from the commerce clause, and the Sixteenth Amendment authorizing a tax on incomes."

Madison stared in disbelief. "The commerce clause? The commerce clause? And a tax on incomes! Don't you realize that if you tax incomes that you have opened up your affairs to the government? Don't you understand that such a tax violates every fiber of the Fourth Amendment? Don't you realize that without a warrant sworn on probable cause that the government cannot look at your personal papers and records? Of course, from the sounds of it, who cares about oaths today . . . certainly not the current president."

"Oh," I smiled. "The government and the IRS gets around the Fourth Amendment by declaring that the income tax is voluntary."

"That's a relief," said Madison. "So, people only pay the income tax if they want to do so."

"Not quite," I said. "When a person neglects or refuses to pay the income tax, their property is seized and sometimes they are thrown in jail."

"Atrocious! How could you have let this happen! You have a virtual dictator in this president! You have built a monster!"

I gulped. "It's a little worse than that. He writes executive orders and thereby has legislative powers to do as he pleases."

"How?" Madison shoved the Constitution in my face. "Where does he have that power? Is there another that I need to know about?"

"In 1933, the sitting president declared that the economic depression was so deep that it must be fought with all the powers a president would have in an actual state of war. Our Congress declared war on the depression and made the president omnipotent."

"But that was 65 years ago." said Madison.

"The War Powers Act has never been repealed. Since 1933, the presidents have all the war powers at their disposal, and they have used those powers to fight wars in Vietnam, in Iraq, in Korea, and many, many other countries without acquiring a formal declaration of war from Congress. We currently have troops and/or agents overtly or covertly stationed in over 100 nations doing mischief in many, and all done without declarations of war."

"Did nobody read the farewell address of General Washington? Did the General not warn us that wars would trouble everyone throughout the world and that our only defense against these wars was to isolate ourselves from them? To refuse to be a part of them?"

I tried to smile, but couldn't. "Mr. President, we have been suckered into many wars in the name of God. Our politicians always claim that God would never allow us to sit quietly by as our brethren are killed by tyrants."

"God?" asked Madison. "Which God?"

"I thought there was only One."

"In a sense, you're right. There is but One Creator, the Divine God of Love, Justice, Truth, Wisdom and Honor. But, there is another, a pretender, a fraud, a liar, a murderer, who goes by many names, but you probably know him best as Mammon, since your country seems to run on this...this commerce clause."

There was a long silence as I reflected upon what Madison had just said.

I knew well which god would have created a fraudulent money system, a fraudulent tax system, a fraudulent war on the economy, a fraudulent Senate, a fraudulent trial of impeachment, a fraudulent involvement in Vietnam, a fraudulent war on drugs. I had to admit that the US of A no longer worshiped the God of our Founding Fathers, but instead followed Mammon. I breathed in quite deeply.

Madison turned toward the door and began to let himself out. I stopped him and said, "Wait, do perjury and obstruction of justice rise to high crimes and misdemeanors?"

Madison's face flushed, and, again he ripped the Constitution from my hands. His eyes bulged as he exclaimed, "Under the original Constitution . . . Yes."
